THE LEGAL AND ETHICAL CONSIDERATIONS IN THE MANAGEMENT OF PERSONAL RECORDS IN NIGERIA: A CRITICAL ANALYSIS OF EXISTING REGULATIONS AND PRACTISES

Abstract:
This paper critically analyses the legal and ethical considerations surrounding the management of personal records in Nigeria. It examines the existing regulations and practices governing the collection, storage, use, and disclosure of personal information, with a focus on their compliance with both legal and ethical frameworks.

The management of personal records is of paramount importance in today’s digital age, as the proliferation of technological advancements and the increased use of information systems have raised concerns about privacy, security, and data protection. In Nigeria, the handling of personal records is governed by various legislation, including the Nigerian Data Protection Regulation (NDPR), the Freedom of Information Act (FOIA), and sector-specific regulations.

This study explores the legal framework in Nigeria, analysing the effectiveness of these regulations in safeguarding the privacy and rights of individuals. It also investigates the practical implementation of these regulations, examining the extent to which organisations comply with the prescribed standards for managing personal records.

Furthermore, the paper delves into the ethical considerations associated with personal data management. It examines concepts such as informed consent, purpose limitation, data minimization, and accountability, highlighting their significance in upholding ethical standards and protecting individuals’ rights.

Through a critical analysis of existing regulations and practises, this study aims to identify gaps, challenges, and potential areas for improvement in the management of personal records in Nigeria. It explores the impact of inadequate compliance with legal and ethical obligations, including the potential for data breaches, identity theft, and misuse of personal information.

By shedding light on the legal and ethical dimensions of personal data management, this research contributes to the ongoing discourse on privacy, data protection, and information governance in Nigeria. The findings provide valuable insights for policymakers, regulators, organisations, and individuals, facilitating the development of effective strategies and mechanisms to enhance the protection of personal records in the country.
