A CRITICAL APPRAISAL OF THE RIGHT TO ENVIRONMENT IN NIGERIA

Abstract:

The right to a clean and healthy environment is an indispensable component of human rights, promoting the well-being of individuals and the sustainability of the planet. In Nigeria, a country grappling with environmental challenges ranging from oil pollution in the Niger Delta to deforestation and air pollution in urban areas, the right to a healthy environment is of paramount importance. This research abstract presents a critical appraisal of the right to the environment in Nigeria, focusing on its legal framework, enforcement mechanisms, and the challenges hindering its effective realization.

Nigeria’s legal framework for environmental protection is comprehensive, with a multitude of laws, policies, and international agreements in place. The Constitution of the Federal Republic of Nigeria, 1999, expressly recognizes the right to a clean and healthy environment. However, despite this robust legal framework, the practical realization of this right remains elusive for many Nigerians. This study delves into the effectiveness of existing laws and regulatory agencies in safeguarding the environment and protecting citizens from environmental harm.

One of the key challenges in the realization of the right to the environment in Nigeria is the implementation gap. Weak enforcement of environmental laws, corruption, and inadequate institutional capacity have hampered efforts to combat environmental degradation effectively. Additionally, socio-economic factors such as poverty and lack of access to justice further exacerbate environmental injustices, disproportionately affecting vulnerable communities.

This critical appraisal draws upon a comprehensive review of relevant literature, legal texts, and case studies to provide a nuanced understanding of the environmental rights landscape in Nigeria. It also assesses the role of civil society organizations, the judiciary, and international organizations in promoting environmental justice.

The findings of this research will shed light on the current state of the right to the environment in Nigeria and offer insights into potential avenues for improvement. Ultimately, the study aims to contribute to the ongoing discourse on environmental rights in Nigeria, providing a basis for policy recommendations and advocacy efforts to strengthen environmental protection and ensure that every Nigerian can enjoy the benefits of a clean and healthy environment.
