Abstract:

In the rapidly evolving landscape of cyberspace, state-sponsored cyberattacks have emerged as a significant threat to international security. These attacks, carried out by nation-states or state-affiliated actors, target the digital infrastructure of other states, organizations, or individuals, with the potential to cause substantial economic, political, and social harm. The rise of state-sponsored cyberattacks has led to an urgent need for effective mechanisms to address this global challenge.

This paper examines the role of international law in addressing state-sponsored cyberattacks and provides an overview of the current legal framework governing cyber activities. It highlights the key principles and norms of international law that are relevant to cyber operations, including sovereignty, non-intervention, due diligence, and the prohibition of the use of force.

Despite the absence of a comprehensive treaty specifically tailored to cyberspace, international law provides a foundation for addressing state-sponsored cyberattacks. The principle of state responsibility holds states accountable for their actions in cyberspace, and customary international law prohibits cyber operations that violate the sovereignty of other states or cause significant harm.
